Reserved Visa Quotas Exempt from Waiting Periods

The new act sets aside an annual quota of 3,200 visas for rural projects (TEAs), i.e., Targeted Employment Area projects and infrastructure projects, allowing applicants to bypass the artificially set waiting period under the old EB-5 law and have their EB-5 applications processed directly as long as the reserved lanes are available.

Rapid Resolution of U.S. Residency through Dual Filing

Another excellent opportunity under the new immigration law is the dual filing policy. Under the new law, EB-5 investors who are already in the U.S. can file both I-526E and I-485 applications and resolve their legal residency in a very short period of time. This is often referred to as a "quasi-green card" because it is essentially the "equivalent" of a green card. This is a provision that was not in the old law.

Free to Enter and Exit the U.S. without Restrictions

Investors can not only get a work card to work legally first, but also get advance parole to enter and leave the U.S. freely without any visa-type restrictions. There is no time and number of restrictions, which greatly facilitates investors to enter and exit the United States.

What is an EB-5 Visa?

EB-5 was established as a category of immigration under the Immigration Act of 1990 (U.S. Immigration and Nationality Act §203 (b)(5), 8 U.S.C. § 1153(b)(5)). This category provides an opportunity for individuals with financial means to obtain permanent residency, also known as a green card or immigrant status, through investment. The primary goal of this program is to encourage foreign investment in the United States, thereby promoting economic development and job creation, while also granting foreign investors permanent resident status in the United States.

Dual Filing and Priority Date Elimination
The attorney can submit both the I-526 and I-485 applications to the USCIS at the same time, shortening the processing time for investor immigration applications.
Unrestricted Entry and Exit
During the waiting period, investors can apply for both a work permit and a re-entry permit, allowing investors and their families to legally reside and work in the United States while their application is being processed.
