Announcement of EB-5 Quota for the Fiscal Year 2024 (Part I)

The United States has entered the fiscal year 2024, covering the period from October 1, 2023, to September 30, 2024. According to the EB-5 visa quota for the 2024 fiscal year, a total of 11,715 allocated visa slots are available. For EB-5 visa applicants in the 2024 fiscal year, there will be a certain number of visa slots, but considerations should also include the allocation for different nationalities and annual inheritance rules.

According to the latest announcement from the U.S. Citizenship and Immigration Services (USCIS) regarding the fiscal year 2024 visa quotas for employment-based immigration, a total of 165,000 visas will be allocated. Based on this information, a preliminary estimate can be made for the allocation of EB-5 visas in the fiscal year 2024.

Established EB-5 Visa Quota for Fiscal Year 2024 = 165,000 x 7.1% = 11,715 visas

2024 Fiscal Year EB-5 Visa Reserved Quota and General Application Quota

The U.S. Citizenship and Immigration Services (USCIS) will follow the "annual inheritance rule" to determine the visa quotas for the next fiscal year, combining the unused quotas from the previous year with the newly established quotas for the upcoming year. Therefore, we can calculate the respective quantities of reserved and general application quotas for the EB-5 visa in the 2024 fiscal year. In other words, the total available quota for the 2024 fiscal year is 22,586 visas.

1. Reserved Visa Quota

Established Quota for the 2024 Fiscal Year: 11,715 visas x 32% = 3,748 visas

Unused Visa Quota from the 2023 Fiscal Year: 4,476 visas

2. General Application Quota

Established FY 2024 quota: 11,715 x 68% = 7,966 visas

Unused visa quota for FY 2023: 6,396 visas
